Subsequently, after necessary amendment in the Rules of Business, the Directorate of Economic Offences has been brought under the administrative control of Home Department by issuance of notification on 14.7.16.
The Directorate of Economic Offences functions and performs the duties and responsibilities entrusted with it by the West Bengal Protection of Interest of Depositors in Financial Establishments Act, 2013 and its subsequent amendment, duly passed by the West Bengal Legislative Assembly with the assent of the President of India.
The Director of Economic Offences has been declared as the Competent Authority in terms of the provision of Section 8 (1) of the Principal Act.
Where any financial establishment (a) fails to make any repayment of deposit, or (b) fails to render service, product or asset promised against the deposit, or (c) commits such default due to its inability arising out of impracticable or commercially not viable promises made while accepting such deposit or (d) commits such default due to deployment of money or assets acquired out of the deposits, such financial establishment and every person conducting the business of such financial establishment are deemed to have committed a default in repayment of deposits fraudulently as per the provisions of the Principal Act. The Competent Authority has the right to require information on the activities of the defaulting financial establishments, power to issue notice to the secured creditors and depositors, power to attach or freeze property of the defaulting financial establishment as per orders of the Court designated for this purpose.
Presently, the Directorate of Economic Offences has been functioning from its office at 5, Council House Street, Kolkata � 700 001, with Sri Jawed Shamim, IPS, as the Director.
